For BMW 325 and others, does anyone experience a 3 second delay when you want sudden acceleration?

mine is a 325iX and its been to dealer 4X for this problem. The last time it was with a factory engineer and he said nothing can be done about it. Its because of the drive by wire system. I have also driven a 330i and SUV. they also have the problem. Is this what they call German engineering. Finally, i could not drive this car and i gave it to my wife and took her 1999 toyota which when you step on the gas, it gives you whatever it can.

Should i sue them for this? Isn't this a dangerous condition?
